Yes! If the animal is being mistreated you are doing the right thing by trying to get the cat out of that situation. You can contact the authorities but I also think the folks at the anti-cruelty society could advise you on what to do. You are doing the right thing by trying to get the cat back! Please call the anti cruelty society directly.
I would say no. The anticruel probably dont get involved in such disputes. If you know of CERTAIN factual incidents you should report these to your local authorities. Unfortunately, once you give up an animal up, you have little say about how the animal is treated. Its NOT YOUR animal any more. Please remember that, be fair to your Aunt.
