If i have a sniper rifle that is below 400 fps, can o use it like an aeg and rather than having the 100ft engagement rule, instead only have the 5ft?

Yes you can, the rules are based on fps not weapon platform, if he is only shooting at 400 then he has a 5 ft MED

No, its a sniper rifle, so you will have to a bid to the rules for the rifle. You will not be able use AEG engagement rules.
