I am a patient there and I would call the practice with this information. They will call the patient in for a pill count and drug test. They take diversion very seriously there.

they wont test him because he is prescribed them for pain. but they have confronted said person once already about running out and trying to if not refilling to soon. he said its because they keep changing the date and he gets confused on when to fill before or after that date. something to that effect he told them. and hes so charming they believed him..dont get me wrong he does take them sometimes for said pain. but usually sells half if not most of them...thank you all for your advice

Call the office and tell them your concerns and see if tell test him before the next refill...

Your best bet is to contact the police. Tell them everything, even if you don't have proof. This is illegal and the police are taking those kind of cases seriously.
