If it is in your name OR his you may sign it over to just yourself without him. If it is in your name AND his he has to sign the title. In a pinch you could sign his name to it but if he can prove he didnt sign it you would have charges against you for forgery and possibly theft

If you're still married, it's is communicable property. If it's still both parties. Either get a attorney or take the vehicle. If the insurance is in your name cancel and explain to them the reason.
