Pumphrey legal team was unbelievable awesome great every question I had was answered every worry I had was taken care of they are spot on. I would recommend them for anyone that has a injunction or any other case. This team is the best of the best! Thank you so much for all the hard work. In a matter of a few weeks this case was dropped and would have never been possible if it wasn't for the pumphrey legal team.

I have never rated any business no matter the circumstances, Pumphrey is a very rude lawyer, he stereotypes his client. First encounter he was very rude, "I am not working for free" "I don't want to handle criminal cases like this any more" Are you capable of paying the $10, 000 or not because I don't want to waste my time " The man has not state how he can help me as a client, but all he was talking about was money. I even said no problem sir, I can pay you before my brother meet up with you, I just want to know how you can help us with the case... "can you pay the $10, 000" I have never been insulted like this in my life. My mom was present there with him because I travel for work. HE'S NOT RACIST. He just stereotypes people based how they look if they can afford it. Just look flashy, does not matter your color he will show you small respect otherwise he will be rude to you. He should look me up; I have a job and can afford to pay the fee. Be nice to everyone

Don assisted a family member with a traffic citation 20 years ago, with excellent results. He was knowledgeable, competent, responsive, and above all, trustworthy, and we never forgot his honesty and efforts. That is why about 15 years later, we referred a family friend needing an attorney to Don. Don successfully represented our friend. Recently, another family member needed assistance with a traffic citation in Georgia. Don does not practice in Georgia, but within minutes of our requesting a recommendation, he (while traveling) referred us to a competent attorney who timely resolved the matter. We highly recommend Don without hesitation.

Should you admit guilt to your defense attorney? Will they still be able to defend you?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

Yes. There is a reason you have a privilege with your attorney. The privilege is there to allow you to tell your attorney everything. By telling your attorney everything, you create an immediate strategic advantage. The attorney knows what information is accurate and inaccurate, who is lying and creating false information and facts. Every person under our Constitution has the right to be represented and the right to have the allegations proven by evidence, the right to confront the accuser, the right to remain silent. Everyone makes mistakes, your attorney should not judge you and should make sure you don't take a bad situation and make it worse.

How do you decide who to hire when choosing a criminal defense attorney?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

Meet the attorney in person. Look at the attorney’s prior experience in handling criminal defense cases (for example a former state police officer and former prosecutor, formerly testified as an expert in the area of criminal defense, are pretty good backgrounds for a criminal defense attorney) and licensed in the jurisdiction where the allegations arise. The total number of jury trials to verdict is the best indicator of experience in the area of criminal defense. The pure number of jury trial’s to verdict indicates experience and the ability to take tough cases to trial. Ask the criminal defense attorney how many cases they have handled that were dismissed, dropped, abandoned by the prosecutor and the total number of acquittals. These questions should be of assistance in deciding who to hire when choosing a criminal defense attorney.

What would you do if it were pouring down and an officer stopped you and ordered you out of your car?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. In Florida, I would recommend getting out of the car. If you are stopped in Florida you are legally allowed to video and audio tape the officer. So you could turn on the video on your phone and capture the entire circumstance as it applies to law enforcement. Be polite, respectful and don’t answer any questions other than personal identification questions. Ask for an attorney and remain silent. Whatever happens, contact a qualified criminal defense attorney in your state and local jurisdiction. I hope this helps, there are circumstances where an officer would need to ask a person stopped to exit the car, it may be for that persons safety. Not your call given the limited facts presented. Again, always be respectful, polite and exercise your rights.

Can you get in legal trouble for catfishing someone?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. In Florida, depending on what your definition of “catfishing somone” you could be committing a criminal offense if you are committing fraud on a person and gaining something from that fraud and your actions are in violation of Florida law. Anyone catfishing should seek a mental health evaluation, its alot cheaper than having to hire an attorney.

What are the reasons why a court case is dismissed?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. I will address only criminal case dismissal in Florida. It depends on the jurisdiction, the prosecutor, the charge, the judge but there are many, many reasons why a criminal case can be dismissed. Statute of Limitations, lack of jurisdiction, lack of identification, violation of constitutional rights, granting of a motion to suppress that eliminates sufficient evidence for the state to proceed, lack of evidence for the case to meet certain minimal standards to proceed. Way to many reasons to go through here. If I had the time I could literally write a treatise on dismissal of criminal charges in the State of Florida. Speak to a qualified expert in criminal defense, in your local jurisdiction.

Can drug-sniffing dogs detect THC oil in a candy?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. I would have to refer you to a wonderful expert Dr. James Woodruff aka “Dr. Sniff” on the specific issue. However, I will add that well trained, qualified dogs have been known to detect cancer and pre-cancerous cells on the human body. There may be THC residue on clothing, packaging, luggage, and other materials that could cause an alert. None of this analysis takes into account the legal requirements that would be implicated based upon the jurisdiction and the status of whether there are any constitutional issues with the detection or alleged detection (some handlers can accidentally cause a dog to alert). If you are asking this question you should probably re-think and get professional advice on what is legal and what is not legal before you wind up getting detained for a long period of time or worse getting arrested. Talk to an expert in your local jurisdiction. Don’t be penny wise and pound foolish, go pay for some sound advice.

How do you stop someone from pressing false charges against you?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. The question should also add in the qualifier “legally” do to stop someone. Depending on the allegation, you should immediately find a qualified expert criminal defense attorney in your area and jurisdiction. Many false allegations can be handled in a manner which can avoid being falsely charged and accused of any crime. False allegations set true victims back 20 years and destroys the integrity of our system of justice. Time and skill is of the essence for this particular question. I personally and professionally detest false allegations. Unfortunately, I false allegations are an epidemic. You should also seek out advice and a referral to a civil attorney after you speak to a licensed, qualified expert criminal defense attorney.

Can you get arrested for threatening to kill someone?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. In Florida, if you were to threaten to kill someone via written text you could be charged with committing a punishable by life felony. I recommend you get immediate legal advice for yourself or anyone you know in this situation. Bad idea to make threats, let alone threats to terminate a human life. Don’t do it.

A package is sent to FL from CA with an ounce of marijuana and was seized in FL. What should the sender expect if their address was on the package?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

It depends. Since the sender is the one in question and the jurisdiction is both State and Federal I suggest everyone involved get advice from a licensed, qualified expert in criminal defense. With the ever changing marijuana laws in the various states and legalization on the rise it would be best to seek legal advice since marijuana is still illegal under Federal Law. Side note: I think it is idiotic that the DEA still maintains that marijuana has no medical value. Try explaining that to the hundreds of thousands of persons who suffer from PTSD, Epilepsy and Cancer. Contact NORML in Washington D.C., they are a great organization and are a great resource for information on this and many other topics related to responsible marijuana laws.

How much do you charge for your services?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

Each and every case is unique and requires dealing with a unique set of circumstances, therefore there are no set-rates for our cases. Please call our office to set a consultation, at which time an attorney will review your case with you and be able to give you a quote for your particular case.

If I am a medical marijuana patient, can I still be arrested for possession?

Pumphrey Law | Nov 7, 2018
Pumphrey Law | Nov 7, 2018

In Florida, under current policies, the only products you are permitted to have would be those obtained from your local dispensary. Having a medical marijuana card does NOT allow the patient to have flower or any product not obtained from a dispensary and the person can still be criminally charged.
