I have had the misfortune of getting injured while at work and have been going through 1.5 years the l&i circus, err I mean, claims process. After being put through the ringer with my state advocate I called for a consultation with Sharper Law. Cheryl answered and took nearly an hour to speak with me at lengths about my situation. King County does use more than one IME doctor. It would be reasonable for them to schedule an IME after the attending physician has diagnosed and treated an injured worker. Keep in mind Self Insured employers are not limited by a reasonableness standard. If they have genuine questions about the medical condition of one of their worker's comp employees, they can schedule an IME. Your best move is to have your attendign physician receive and respond to the IME as appropriate in writing. He could also refer you to a specialist for an additional opinion. There are statutory exceptions to the general rule that all persons on the job are covered by L&I. Your situation very likely meets this exception. RCW 51.12.020 Employments excluded. (1) Any person employed as a domestic servant in a private home by an employer who has less than two employees regularly employed forty or more hours a week in such employment. Said another way, since a nanny is likely a domestic servant, and since few homeowners have at least three domestic servants, then you would not covered unless the employer chooses to optionally cover you. You probably already knew that since you indicated that your claim was rejected because the employer opted out. You have a potential premise liability claim against the homeowner. This type of claim requires proof of negligence. Talk to a good personal injury attorney about your claim and how, if at all, you can establish liability.
