As a dual national, you may be required to use your original country’s passport when you’re entering or leaving it. United States law allows for this (it doesn’t say anything against it), so you should check with your original country when you have planned travel. It doesn’t generally matter which passport you use to enter other, unrelated countries – though you may prefer to use one passport over the other for personal reasons. Additionally, some countries that allow travelers with U.S. passports sometimes don’t allow travelers using passports from other countries, and vice-versa; in a case such as that, you’d want to use the passport that enables you to enter the country you want to enter.
R visas are nonimmigrant visas available to religious workers who wish to enter the United States temporarily to work in a religious vocation or occupation, or to perform temporary religious work.
Green card holders (lawful permanent residents of the United States) are allowed to file immigrant petitions for their stepchildren. If you’re a permanent resident who wishes to petition for your stepchildren, you must provide proof of a relationship with your stepchild (as well as proof that demonstrates your immigration status). Your attorney can help you with the process.
An H-1B visa is a non-immigrant visa in the United States. It makes it feasible for USA companies to temporarily hire workers from various other nations to execute specialized jobs.
There are several requirements to obtain a K-1 Fiancé Visa. -You must be a U.S. citizen. -You must both be eligible to marry. -You must prove that you’re in a bona fide relationship. -You must prove that you have met in person at least once within the past two years. -The U.S. citizen partner must make enough money – and prove it with a tax return – to meet or exceed 100 percent of the federal poverty guidelines.
If the U.S. government grants your visa petition to study here, you can receive your visa up to 120 days before your program of study is scheduled to begin. However, you can’t enter the United States on a student visa (of any type) more than 30 days before your program’s start date.
Sponsors must certify that their income levels are at least 25% above the existing Federal Poverty Guidelines. If the sponsor is on active duty in the U.S. Military and wishes to sponsor a Green Card applicant, the income must be at least equal to these federal guidelines.
Each year, the U.S. government holds a “diversity lottery.” The lottery randomly awards up to 50,000 people with immigrant visas. However, you can only apply to participate in the lottery if you’re from one of several eligible countries.
It can take between 10 and 38 months to get a green card through marriage. However, every case is different – and it depends on whether you’re married to a U.S. citizen or green card holder. If you’re married to a citizen, your attorney can use concurrent filing; if you’re married to a green card holder, you must wait for the U.S. government to approve your Form I-130 before your lawyer can file your Form I-485. It also depends on whether you currently live in the U.S. or abroad. If you live abroad, you’ll have to go through consular processing, which can take longer because the National Visa Center must process your petition before sending it on to the U.S. Department of State.
During your free consultation, you’ll be able to ask the attorney several questions of your own. You can use your time to determine whether you and the lawyer are a good fit for each other, as well as get legal advice about your case.
Your first consultation is free
