Yes. Whether you are confined to the hospital or otherwise unable to travel to our office to meet with us, our attorneys will come to you to make sure you have access to legal representation.
We handle workers’ compensation cases on a contingency fee based system. This means our fees are based on the outcome of your case. If we win compensation in court or through a settlement with the insurance company, we’ll charge you a percentage of the award. If we fail to recover compensation for you, our services are free. In Illinois, state law limits the amount we can charge you for our work in your workers’ comp case. As a result, you won’t pay us any more than 20% for work related cases. If your case is high-value, you may owe us much less. This is because Illinois law caps our fees at 20% of 364 weeks of permanent total disability payments.
If you were attending the event in the scope of your employment as a teacher, you are likely eligible for workers’ compensation benefits. However, depending on where the event took place and how the injury occurred, you may also be able to file a personal injury lawsuit against the property owner, event planner, or other third-parties. For accurate answers, we’ll need to take a closer look at your case.
Chicago police are not covered by the Illinois Workers’ Compensation Act. Instead, Chicago police and firefighters have a parallel disability benefits system to address work injuries that occur while they are on duty. While the majority of protections are similar, the terms are different from those provided by the Act.
It depends. If the other worker was also employed by your employer, we’ll need to take a look at when and where the accident happened, and what the coworker was doing at the time of the injury. If the accident was caused while your coworker was under the control of your employer, you’ll need to file a workers’ compensation claim. If the worker was not employed by the same company as you, however, or did not follow safety rules, you may be able to file a workers’ comp claim simultaneously with a personal injury lawsuit against the coworker.
