What kind of losses can I get paid for if I was hurt in a crash?

Motor vehicle crash victims may be able to recover compensation for a variety of economic and noneconomic damages including medical bills, lost past and future wages, pain and suffering, loss of enjoyment of life, and emotional distress. Additionally, if the other driver caused the accident intentionally or his or her behavior was grossly negligent, you may be able to get punitive damages.

The insurance company keeps calling me. Do I have to answer their questions?

You are not required to speak with the other party’s insurance company. In most cases, it’s wise to have your injury attorney communicate with the other insurance company on your behalf. When it comes to talking with your own insurer, however, it’s a different story. This is because benefits may be available to you through your own policy. When you communicate with your insurance company, proceed with caution. Do not allow recorded statements, don’t admit fault, and if in doubt, speak with your lawyer before answering questions.

How do I know if a doctor was negligent?

A negative outcome doesn’t necessarily mean your doctor was negligent. If, however, your physician’s action or inaction failed to meet the standard of care that is expected of a competent physician in similar circumstances, your doctor is likely negligent. If your doctor’s negligence caused you harm, a medical malpractice lawsuit might be in order.
