Yes. The final repair process is very specific and requires the consumer, (or their lawyer), to provide written notice of the need for final repair. The written notice must be delivered by return receipt service. The final repair must take 5 business days or less to complete. Notably, the written notice may be mailed the third repair attempt for the same defect or condition or after 25 days out of service within the first year from the date of delivery.
The starting point for the Michigan Lemon Law is to know what vehicles qualify. 1. New vehicles qualify 2. Vehicles purchased or leased for personal, family or household use qualify 3. Vehicles that have defects that impair the use and/or value of the vehicle qualify What vehicles do not qualify 1. Used vehicles generally do not qualify 2. Boats, RV's, motorcycles and ATV's do not qualify 3. Vehicles purchased/leased for business do not qualify 4. Vehicles purchased "as-is" do not qualify Reasonable Number of Repair Attempts The vehicle must be subject to at least 3 repair attempts for the same defect or condition that substantially impairs the use or value of the vehicle, OR at least 25 days out of service within the first year from delivery
Possibly. The first step is getting on the Do Not Call registry. If you are already on that list you should document the calls. Date, time and phone number. If you are receiving a lot of calls from one source, your case will be more attractive to a lawyer. Keep in mind that some robocalls are scams - most of these cannot be prevented. If legit companies are calling you without authorization you should consider contacting me to discuss in further detail.
