He might end up paying child support, I'd leave well enough alone unless he is already paying child support. And a lot depends on the county the child and grandparents live in. In North Carolina grandparents have no natural rights, barring those granted by a court order signed by a judge.
That's a question that they can help you with. Ultimately, a real lawyer will have to come to a conclusion based on facts as to the validity of an order. Getting a judge to rescend an order is very difficult. They are a low cost or free law service, but you will need to sign up with them for help, and write down all of these questions so that you won't forget to ask. And if you find that they can't help you, call the lawyer referral line. It's an 800 number. Best of luck, and I'm sorry you're going through this.
