I wish there were more than 5 stars to give because THIS Law Firm truly deserves it! For over a year I was with an accident attorney that I just wasn't happy with (not returning my calls, not keeping me up to date on my case, sending me to a chiropractor that was hussling me out of my money) and that just didn't have my best interestat at heart. Car accidents are very unfortunate events for all parties involved and securing an attorney is not always as easy as it seems. Instead of utilizing one of the firms with the heavy marking campaigns, I decided to take the word of mouth method in which a close family member referred me to the Simon Law firm and specifically Mr. Harrison Spires. If you have an attorney, you need to let your insurance adjuster know that you will not be discussing much with them. They are after a profit and will try to settle your insurance claim for as little money as possible
Once we demand the insurance company to compensate you for your car accident, we usually file a lawsuit after that. Once in litigation chances are the case is resolved in mediation. When we sit down with the defense and mediator the case usually doesn't need to go to trial.
Sorry for the delay. We don't always see these questions. Short answer is "yes." Medical providers are supposed to bill the medpay first and then health insurance. If it is a chiro you are dealing with, go to an orthopedic medical doctor on your plan instead.
Not unless the reading of the MRI led to a serious medical consequence. You have to understand that medical malpractice cases cost around $25,000 in expert fees just to get filed so lawyers cannot afford to take on cases where the medical consequences of the mistake are mild or moderate. The case has to be worth in excess of $300,000 to make the investment worthwhile as many of these cases don't work out and they rarely settle. In other words, it take a severe and lasting injury to justify the expense and time involved. Many medical mistakes are legally a case, but no one can afford to file them.
