I just got my first drug possession charge while I was on vacation in South Florida, am I going to jail?

Any drug possession charge in Florida always has the possibility of getting punished with jail or prison time. There are a lot of factors at play, however. For one, Florida law doesn't care if you were on vacation. If you were charged with a drug possession crime in Florida, you will be prosecuted in Florida regardless of where you live. Consequences for drug possession in Florida depend on the drug you had in your possession, the circumstances around the possession (did you know you had it? did you intend to sell it?) and the amount of the drug you had. For simple possession cases, you could be looking at up to 1 year in jail to 5 years in prison and fines of up to $1,000 to $5,000. If you hire a lawyer like Rossen Law Firm right away, we may be able to work with prosecutors and negotiate before your charges are formally finalized and filed. There is a chance that you might not even have to return to Florida for any court dates depending on the deal we can get.
