Hari came in late in the game for my Mom's divorce. Our family appreciated how responsive he has been in his communication, responding quickly when we have had concerns. Before Divorce was liberalized in the 1970s it was possible for a spouse to deny the other their request for divorce. However, this is no longer the case, as Divorce laws have changed, meaning that one spouse can no longer trap the other in a marriage by denying their divorce request. The idea that courts favor mothers in custody cases is actually a very common myth. It is the court's job to bring an unbiased ruling to each case. It is not true that a court will give a mother custody primarily because she is the mother. Courts are particularly concerned on which parent would be able to provide the best, physical and emotional care, as well what is in the child's best interest.

Yes! When you get divorced you will either have a sole custody or shared parenting order which dictates what happens with your children. The court will need to determine how decisions are made, what the parenting schedule will be, and other logistical issues. If there is a disagreement with how those rights will be allocated, the court will likely appoint a Guardian ad Litem to be its eyes and ears. Knowing how to communicate with the Guardian and with the court, knowing what to say and what not to say, is difficult and something we can help you accomplish effectively.

My husband was the sole-earner while we were married, am I entitled to any assets in the divorce?

Yes! In Ohio, you are entitled to 50% of all marital assets. A marital asset is anything acquired during the marriage, regardless of who the asset is titled to. What does that mean? Even if all the bank accounts, retirement accounts, and vehicles are in his name, you still get 50% so long as those assets were acquired during the marriage.
