Back in 1998 I was injured in a tragic car accident. Paralyzed from the chest down. Fast forward to 2017 another tragic car accident!! Totaled my handicap accessible vehicle, along with severe secondary injuries to my ribs. Unfortunately will never heal as I use my upper body for my livelihood. A family member highly recommended to call Shelly Law Offices, LLC. Carol and Katherine took me under their wing for the negligence of not only the driver, an continuation of my next vehicle purchase. Two separate cases, neither accident my fault. They we're absolutely phenomenal with the justice I deserved!! Look no further if you want compassionate, extremely professional/ highly personal aggressive lawyers that will fight for you and your loved ones. I will never forget the respectfulness your law firm has given to me in order to move on with my life. Thank you from the bottom of my heart. Sincerely, Milene Tannenbaum

Carol Shelly and her team did an outstanding job representing my wife and I after we were victims of a horrible car crash. Carol was not only tenacious in representing our best interests, but also genuinely concerned and compassionate regarding our injuries. She kept us informed about the progress of the case and was relentless in seeking the appropriate damages for our injuries. If you are looking for someone to represent you and fight for your rights, I would strongly recommend Carol Shelly!

Questions & Answers

Whom can I sue if a nurse gave me the wrong medication?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

It varies from case to case and you will need to speak to a medical malpractice attorney. However, the most commonly named negligent parties in these types of situations might include the nurse, the doctor who prescribed the medication, the pharmacist, and the hospital. There might be other parties, too, depending on your circumstances. You will need to prove that damage was done due to the prescription error to file a claim.

I may be partially to blame for the crash I was in. How could this affect my car accident case?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

It might result in less compensation, but it does not mean you shouldn’t speak to an attorney. Even if you were only partly to blame, you could still be eligible for compensation. This is why it is always best to speak to a personal injury lawyer to evaluate your situation. It is also important not to admit any blame at the scene of the accident. Even if you believe you bear some fault, it is best to avoid saying so.

What steps should I take to protect my rights after a car accident?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

There are several things you should do following a car accident. The first and most important is to seek medical care. You should visit an ER or see your doctor regardless of how serious you deem your injuries. Next, you will want to make a record of everything you remember about the event. Ideally, this will include photos. If you remain at the accident scene because your injuries are not severe enough to seek emergency care, do not admit any wrongdoing. Exchange only identifying information and contact an attorney as soon as possible.

What compensation will I be able to get in a lawsuit over my car accident?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

Damages in any case are based on the injuries you suffered, and they vary from case to case. The types of damages that can be sought include medical bills, damage to property, lost wages, and pain and suffering. In some cases, damages can be sought to punish outrageous conduct that led to the accident, but this is not that common. It is important to speak to an attorney who will protect your interests and make sure that you receive all compensation to which you are entitled.

I was in a car accident and have been told I should get a lawyer. But I have car insurance. Will my car insurance cover my needs after an accident?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

Your insurance company will pay for your medical bills up to the limits of your insurance policy. They may also pay for wage loss and your property damage, depending on what insurance coverage you purchased. If the accident was caused by another driver, then the insurance company for the other driver is responsible for your injuries and any financial damages caused by the car crash. There are also situations in which extenuating circumstances led to the accident, such as a vehicle defect or poorly organized parking lot. It is always best to speak to an attorney to ensure you are protected after a car crash. It is important not to speak to the other driver’s insurance company until you have an attorney representing your interests.

What qualifies as a wrongful death lawsuit?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

A loved one might be eligible to file a wrongful death claim if he or she has lost a loved one in a car crash, or as a result of medical malpractice, or another event. One of the simplest ways to tell if a wrongful death suit would be appropriate is to ask “could a personal injury or medical malpractice lawsuit been filed had my loved one survived?” If so, you might be able to file a wrongful death claim. It is important to speak to an attorney who specializes in wrongful death lawsuits.

What is meant by “a breach of the standard of care” in a medical malpractice case?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

A breach in the standard of care means that the person providing your care was negligent — that they did something that a reasonable doctor would not have done. Doctors and other medical professionals are responsible for making all reasonable efforts to protect patients from harm. To prove negligence, you must show there was a breach in the duty of standard of care.

What is the statute of limitations for medical malpractice in PA?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

The statute of limitation is the length of time someone has to file a legal claim after he or she has been injured due to the negligence of another person. In most cases, the statute of limitations in Pennsylvania for medical malpractice is two years. This is also the same for personal injury and negligence. However, every case is different and there are situations in which injuries are not apparent for some time. It is important to speak to an attorney about your situation if you have been injured by a medical care professional regardless of when the event occurred.

If I had known the risks associated with my surgery, I would not have agreed to the procedure. Can I sue my doctor?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

Maybe. If your doctor failed to explain the risks associated with your surgery or your doctor was unaware of those risks and should have known them, a medical malpractice lawsuit might be appropriate. You will need to show that the procedure caused some type of harm and you will need to show that the risks would have impacted your decision to have the surgery.

What kinds of damages (money awards) are available in a medical malpractice case in Pennsylvania?

Renzo Morales | Oct 18, 2020
Shelly Law Offices, LLC | Oct 18, 2020

In Pennsylvania, you might be eligible for two basic types of damages, which include compensation for financial losses caused by an event and compensation for pain and suffering. The latter has no exact dollar amount and is determined on a case-by-case basis. The former is related directly to the cost of your medical care, lost wages, and property damage. Every case is different, so it is important to speak to a personal injury attorney about your case.
