Ms Stacey Jo Townsend is truly a blessing! My son had a near fatal accident in November, traumatic brain injury, coma , steel plate in head, etc! He was charged with running a stop sign. I am a bodyshop owner of 20 plus years and knew he wasn't hit at 45mph. However EVERY ATTY I called said he was at fault nothing they could do ! I just happened upon Ms Townsend that practiced in NC and SC and she knew the intersection. My son obviously could remember but Stacey actually TOOK MY SONS CASE! SHE INVESTIGATED THOUROUGHLY! Johnnie Cochrane , F Lee Bailey style and ended up getting a video of accident! I can't Thank her enough ! My son ended up being at fault bthe burden of not killing the person that did this to my son was lifted from me!!! She wouldn't take a tip or anything from me and I offered. If ever need an atty she's it and I offered details for life and she wouldn't accept! Best atty Ever!

I never hired or need a lawyer before, but you cannot win against the insurance companies. My lawyer, Todd, went to work for me and got the job done. I’m very thankful for the help I received.

Yes, it’s possible for you to collect compensation for damages in a truck accident even though you were partially at fault for the wreck. South Carolina follows a modified comparative negligence system in personal injury cases. This system enables you to collect compensation from a driver whose negligence caused your accident and resultant damages but allows your award to be reduced according to your percentage of fault in the crash. https://www.derricklawfirm.com/faqs/comparative-fault-in-a-florence-south-carolina-truck-accident-south-carolina-truck-accident-lawy.cfm
A wrongful death claim is a legal action that surviving family members can bring against the person or entity responsible for their loved one’s untimely death. The law states that a wrongful death claim is, in essence, the personal injury claim that the deceased could have filed against the party who harmed him had he lived. In South Carolina, this type of claim is typically brought on behalf of a spouse and children. If there are no spouse or children, parents or other heirs could be eligible to file a claim. https://www.derricklawfirm.com/library/compensation-for-a-myrtle-beach-wrongful-death-claim.cfm
Your first priority after a boat wreck is to see to the safety of all passengers. Anyone who does not have a life jacket or flotation device should be given one. If you’re physically able to do so, you should first assist anyone who’s fallen into the water since the majority of boating accident fatalities result from drowning. https://www.derricklawfirm.com/faqs/what-to-do-after-a-south-carolina-boating-accident-south-carolina-boat-accident-lawyer.cfm
Yes, there is a statute of limitations for workers’ compensation claims in South Carolina, but it’s not the same as the statute that applies to personal injury claims. In many personal injury cases, you have three years to file a lawsuit (with some exceptions) against the party who caused your injury. For a work-related injury case, however, you generally may not file a lawsuit against your employer or a co-worker at any time. https://www.derricklawfirm.com/faqs/statute-of-limitations-for-sc-workers-compensation-claims.cfm
Premises liability law refers to the right for someone to file a lawsuit against a property owner if he or she sustained injuries while on the property. The injured party must prove negligence before the other side will consider making a settlement offer. https://www.derricklawfirm.com/library/myrtle-beach-premises-liability-attorneys-slip-and-fall.cfm
You might be able to sue a liable third party for a work-related injury without jeopardizing your workers’ comp claim. Because the two legal actions are completely separate, however, the process could get complicated. You’re most likely to get the compensation you need by working with an attorney. https://www.derricklawfirm.com/faqs/compensation-for-third-party-work-related-injuries.cfm
You don’t need professional photography skills to take helpful pictures. You can simply use your cell phone camera to try and get clear, well-focused shots of; the general scene, exterior and interior damage of the vehicles, and any injuries you or the passengers may have.
If you’re injured by a drunk driver in South Carolina, you might be able to file claims against more than one party, depending on the circumstances and details surrounding your wreck. A workers’ compensation claim can be filed in South Carolina if the injured worker was hired in South Carolina, injured in South Carolina, or if South Carolina is where your employment is located. Yes, if you are an employee who sustains an injury while performing job duties at home, you are covered by SC workers’ compensation which almost every business with four or more employees is required to carry. You must, however, be able to convince your employer’s insurance company that your injury or illness is work-related. The short answer is no. You can’t be denied benefits for a new claim because you’ve received worker’s compensation benefits in the past. Workers’ compensation is no-fault insurance that almost every South Carolina employer with four or more employees must carry. If you’re injured on the job or develop an illness from performing your duties, workers’ comp pays for: • Medical expenses • Two-thirds of lost wages • Vocational rehabilitation • Disability care • Death benefits It’s not necessary to prove your employer caused your accident or illness. If it occurred in the course of your work, you’re entitled to benefits—and you can’t be fired for filing a claim.
Yes, it’s possible that you can be terminated—but not in retaliation for filing a workers’ compensation claim. Worker’s comp is no-fault insurance for any accidental injury or occupational illness you might suffer while performing your job duties. It covers your medical expenses and provides temporary monetary benefits lost due to being taken out of work for recovery. Your employer may not penalize you for filing a legitimate workers’ comp claim. For more information about your workers’ comp claim, speak to an experienced attorney at The Derrick Law Firm today.
Claims are often denied due to application errors, policy ambiguities, lack of coverage, and simple errors. Insurance companies do have systems to appeal a denied claim. They may not make this process straightforward, but it can be possible to revisit your claim and obtain the compensation you deserve. An experienced attorney can investigate your claim, provide additional information, negotiate with the insurance company, and act as a tenacious, knowledgeable advocate.
In most cases, workers’ compensation claims are paid by insurance companies. Almost every employer in South Carolina carries workers’ compensation insurance to cover work-related injuries and illnesses. Call an experienced workers' compensation lawyer to review your specific case and to see what benefits you may be entitled to through workers' compensation.
If you’re a victim seriously injured in an accident caused by someone else, the very fact that it wasn’t your fault is the reason you need an attorney. Without one, you might end up stuck with economic damages that should be paid by the at-fault driver: Medical expenses Property damage Lost wages Call today for a free case review at 843-488-5360.
Yes, we do. While adjusting to life after such an overwhelming loss, you don’t need to spend your time hunting down documents and chasing after insurance companies. A Myrtle Beach wrongful death attorney will handle these aspects of your case without requiring any upfront payment: ● Hiring investigators ● Gathering police reports and medical documents ● Calling on expert witnesses ● Paying court filing fees ● Negotiating with insurance adjusters There’s another extremely important reason to retain a knowledgeable legal team in this difficult time of your life. An insurance carrier or the negligent party responsible for your family member’s death may offer a settlement that is much lower than the total amount you could otherwise receive. Through the help of a firm with experience negotiating wrongful death cases, you will more likely receive the maximum amount you are legally owed.
