Mike Geiser of GBM Law helped me through the hardest part of my life. In 2020, I was in a motorcycle accident caused by another driver in a car. Do I need an attorney for my injury?

Yes and there are many reasons for this. A. Insurance companies have a staff of lawyers and investigators advising them from the outset of every claim. So should you. B. Insurance adjusters work for the insurance companies, not you. They are evaluated by how much money they save their company, not how fairly they treat you. The insurance company does not have your best interests in mind. C. The adjusters are taught how to appeal to persons making a claim and will appear actually try to befriend the injured victim in the hopes of getting a better deal for the insurance company. An attorney serves as your objective partner. D. Insurance companies try to take advantage of your emotional and financial stress after an accident by offering quick, but low settlement offers. How long will my accident case take?

A. Many cases are completed within 6 months. Once you have completed your treatment and we have obtained your final medical records and bills we will send a settlement proposal to the insurance company. Once that is received it could take several months of negotiations before the case is settled. If you require ongoing treatment, that will be factored in once we have a clear picture of the treatment required. We will consult with you every step of the way. B. More serious injuries take more time. This is because you are not in a position to even discuss the settlement value of your case until you have either fully recovered from your injuries or have reached “maximum medical improvement” per your doctors. C. If the case goes to trial the process could be much longer, depending on a variety of factors. Most cases that go to trial can take anywhere from one to two years.

Will my insurance rates go up because of my car accident?

Your rate should not increase if you did not cause the accident. If you are at fault for the accident, your rates may go up. However, sometimes, even if the accident is not your fault your insurance company will raise your rates. It depends on the specifics of the accident, your history of making claims and the type of coverage you have.
