For each court, there are appeal courts that assess the judgements made by Judges of courts within their sphere of influence, if the ruling was in fact appropriate and if it constitutes a fair trial.

Aside from the fact that our system of justice is not designed for a pro se litigant I found the Clerks office to be harmful and ill informed. The facts of the case are straight forward. In 2017, I was hit in the rear and only awarded 50% judgement. I appealed the case and tried to introduce a couple of new photos as evidence but had to go to the lower court in order to do so. Unfortunately, it was at the same time as COVID began and the lower court was closed. Shortly thereafter the Applellate Term dismissed my case. I tried three times to file a motion to vacate the dismissal but it was consistently being rejected for frivolous reasons. My biggest obstacle was having to constantly find someone to satisfy an affidavit of service which costs approx $75 each time. In the course of 1.5 years I must have filed 10 times already. Plus, I had to pay an initial $160 fee to retrieve a written copy of the lower court case. I guess their unaware of the use of technology in the 21st century. In sum, it is an unfair, antiquated, byzantine system of justice that favors those who are affluent or connected as in the times of the Roman Empire.

Depends on the number and complexity of the issues, as well as whether you were the appellant or respondent. If you were the appellant, the respondent has 30 days to file a response, but that time could be enlarged. Once respondent has submitted their briefs, it can take anywhere between 3 to 6 months for oral argument, then another few weeks for decision.

File an appeal in family court for the judge to review the case.

Does the appellate court appeal decisions made by the magistrate serving child support

Deborah Curry | Oct 2, 2017
Sophia Valentina | Oct 2, 2018

You would have to first appeal to the family court and they will have a judge review the case first and see if the support magistrate acted properly. If your appeal in family court is denied by the judge, then you can appeal to the appellate division.
