The first thing you should do after any car accident in South Florida is call 911. This is especially important if you are injured - even if it seems minor. An immediate 911 call may also provide you the opportunity to report the license plate number to the dispatcher in case the other driver involved in the accident flees the scene. Getting a police report is vital to a Florida personal injury case. Unless you are seriously injured, however, we would recommend not taking an ambulance to a hospital. It will be very expensive and will use up much of your PIP coverage before you even begin treating and recovering from your car accident injuries.

● Improper Fencing: Outdoor swimming pools are required to have a fence or a barrier around the pool with a self-closing gate under Florida law. ● Slip & Fall Accidents: If conditions around the pool are not appropriately maintained, an owner could be responsible for a slip & fall accident. ● Lack of Supervision: If a pool accident happens because an adult left children unattended around the pool, an owner can be found liable. ● Poor Maintenance: Poor maintenance can take the form of chemical imbalances in the water to uncovered filtration systems that lead to injury.

As the state of endless summer, many single-family homeowners in South Florida have swimming pools. A pool is a perfect way to relax and cool off for adults and offers hours of activity and fun for children. While there are many benefits to owning a pool, it also comes with unique responsibilities and liabilities for homeowners. As a pool owner, you must take safety measures to ensure that children, family, friends and all visitors are safe from harm on your property. According to the CDC, drowning is a leading cause of injury and death for children between the ages of 1 and 14 years old. Drowning is the top leading cause of death for children ages 1 to 4 years old.

You agree to reimburse your medical provider for any bills that were caused by a third party, this is called a "health insurance lien". In other words, when you are hurt in a Personal Injury matter and end up using your health insurance for some or all of your treatment, they are entitled to get reimbursed for those expenses. This will apply when you are not at fault for the incident that causes the injuries. Additionally, the health insurance company is only entitled to get reimbursed for the treatments that were related to the injuries from the incident and nothing more. How Long Will My Lawsuit Take In Florida?

There is no exact answer to this question unfortunately. Once you file a lawsuit for a car accident or slip and fall case, there is a process that must be taken to get to the finish line. There are complaints to be filed, discovery process, depositions, mediations and then a potential trial. I like to tell people that the court process takes a while and to expect anywhere from one to two years on average to get through the process. However, like anything that is an average and it could end up shorter or longer.

Who Pays For The Tow Yard Expense If My Car Is Taken There After An Accident?

This is one of those things that no one thinks about after a car accident! Who pays for the actual tow yard expense and how much does it cost? The cost of the tow yards vary, but on average it is anywhere from $50 to $100 or more per day to have your car sit there. The real issue becomes how long can it sit there and who pays for the cost of that? The answer is the insurance company who caused the accident is the one who pays for that expense. It is usually picked up and sold for salvage if the car is totaled. However, if you delay in the "process" of getting the paperwork completed so that it can be moved from the tow yard, you could be held responsible for those days of delay. The point is, be careful and do not waste time on this issue.

Why is car insurance so expensive in Florida?

Law Office of Andrew G. Rosenberg, P.A. | Apr 1, 2022
Law Office of Andrew G. Rosenberg, P.A. | Apr 1, 2022

One of the main reasons car insurance is so expensive in South Florida is because more than 20% of Florida drivers don’t have car insurance. The annual insurance rate in Florida averages about $2,000 per year, which is 2x higher than the national average of car insurance rates. Florida is the fifth most expensive state to buy car insurance in the nation. Uninsured drivers increase the cost of insurance for people who do buy insurance to protect themselves and their cars. This makes it very important to have uninsured motorist coverage on your policy.

If You’re Seriously Injured, You Might Be Able to Sue Unfortunately, the no-fault insurance benefits in Florida are limited, and they may not cover all of your costs. However, you may still be able to collect damages in excess of the PIP insurance limits by filing a: Claim against the drunk driver’s bodily injury liability (BIL) coverage. Claim against your own uninsured/underinsured motorist (U/U) coverage. Personal injury lawsuit against the drunk driver. However, to do so, your injuries must meet Florida’s injury threshold, meaning that one or more of the following is true: the effects of the accident are permanent, the accident resulted in scarring or disfigurement, or the accident caused the loss of important bodily function.

My Car Is Totaled In An Accident In Florida And It Is At The Tow Yard, What Should I Do?

Law Office of Andrew G. Rosenberg, P.A. | Sep 28, 2021

This is a simple one to handle. Get it out of the Tow Yard as soon as possible. Unfortunately, this is one of those "hidden expenses" that people are not thinking about after they are in a car accident in Florida. The Tow Yard charges a daily fee to store the totaled car on their property. Thus, the sooner you (or your insurance company) can get it off of their property, the better due to these daily charges.
