I was referred to Brian McMonagIe office through a friend that had gone through similar situation. To be honest, I didn't know what to expect since I’ve never gone through an experience like this before, where I needed legal representation. But when I met him, he took the time to examine all of my paper work I had from the few years , that i had dealt with on my own. He was straight to the point and did not waste time. I immediately realized how knowledgeable, passionate he was about what he does, the entire time he was very professional and transparent. I believe that was what made me trust him. I fell from scaffolding at work. I went by ambulance to the hospital. I stayed in the ICU for 2 weeks. I have ruptured discs in my back and a broken pelvis. Now the hospital and the ambulance company are sending me bills. What should I do?

You are not liable for these expenses. Ask your Employer for a claim form---and the name of the workers’ compensation carrier. Your medical bills should be submitted to the insurance company. In California, it is unlawful for an Employer not to be covered for workers’ compensation.

Yes---depending upon the evidence. Heart attacks can arise from work duties that are physically strenuous. Undue emotional stress can also be a contributing factor. Certain employees who work in public safety are entitled to legal presumptions regarding heart injuries.

Physical injuries which manifest as a result of emotional stress on the job are generally considered to be work-related injuries. Interactions with your Employer typically fall within "personnel actions." Personnel actions which are either 1) discriminatory; 2) unlawful; or 3) lack good faith---can form the basis of a compensable mental injury.
