Dan is a highly experienced attorney in estate planning and administration, employee benefit and tax matters. I have had the opportunity of working with Dan for over 35 years in all three areas of the law and neither I nor my clients have ever been disappointed with his work. He is always timely in his responses and a wonderful resource.

Margaret Badura was quite rude in a phone consultation, saying she didn't have time for this and that she makes $250/hr. "I don't have time to be your penpal." Wow ! We were readily prepared to pay for her services, but after this call. Nope.

I required legal representation in the state of Nebraska (I live in GA) and Badura & Wintz Law Offices stepped up and took my legal case on. My attorney, Dan Wintz is very professional and knowledgeable of the legal system. Communication between myself and their office was outstanding and Dan got resolution and closure to my legal issue. I highly recommend this law office, they will work for you, litigate if needed and get the job done.

Questions & Answers

Why would I want a Power of Attorney for my financial affairs or healthcare decisions?

You need to designate those who will speak for you and make decisions for you, if you are unable to. Think of these powers of attorney like they are kinds of “insurance policies” just in case you become incapacitated and can’t effectively make or communicate financial, medical, or living arrangement decisions. You remain in control as long as you are capable and safe, but you chose who will act for you if the need arises without the need for guardianship or conservatorship court proceedings. For financial affairs, your agent will need to identify your assets, make sure that they are kept safe and secure, make sure your bills and taxes are paid, and make sure that your assets are invested appropriately. For healthcare decisions, you need to make sure that your agent understands your wishes; for example, remaining in your home for as long as safely possible. You need to have conversations with your healthcare agent ahead of time to share what you want if you are unable to communicate.

We hope you will understand that we do not publicly answer legal questions as they might result in a conflict of interest with an existing client, create an unintended attorney/client relationship, provide an incorrect or incomplete answer where we do not have all the facts, or inadvertently disclose information about the person(s) asking the question. We request that you call and make an appointment so that we can serve you. Thank you, Dan Wintz
