If you pass a drug test, you can still be charged with drug possession. It’s important to keep in mind that you don’t need to be actively using the drug in order for it to result in a possession charge. Police can still arrest you for possession of a drug that you have no intention of using.

In the state of Rhode Island, you can be arrested for possession of paraphernalia, which is defined as any kind of product or equipment that’s designed for using or cultivating controlled substances. Rhode Island Code Chapter 21-28.5 states what classifies as drug paraphernalia. Here are just a few.
