How much child support do I have to pay?

This is hard to answer without more information. The amount of child support is set by the state. You can calculate the standard amount by filling our the Child Support Worksheets and following all directions. You can get the standard forms to do that yourself from the Washington Courts website: http://www.courts.wa.gov/forms/?fa=forms.static&staticID=14#FamLawForms But there are other factors involved. For example, you may qualify for a different amount if you have significant time with your child, if you have other children, or you have extraordinary involuntary debts (such as medical bills from an unexpected illness). When the divorce is done, will I owe you money?

For our flat fee clients, no. All the work is listed in our engagement agreement and you've already paid. For our hourly rate clients, we do our best to avoid that situation. We ask that every client deposit an advanced fee into a trust account. We then ask client's to approve any anticipated work before we get started. And, if the client agrees, we ask that the anticipated costs be deposited into the trust account. But sometimes there are unexpected surprises and we work to protect our client's interests from surprising action by the opposing party. Please ask if you have any further questions.

Will you charge for every call?

Not if you choose one of our flat rate plans. All communication is already calculated in the flat fee. However, if you have chosen our hourly rate, we do charge for all the time we spend working on your case, so yes. Now, if you are calling to ask about your invoice or something similar, we do not charge for those phone calls.

Does it matter if I file for divorce or separation first?

Sometimes. Sorry, but there are a lot of factors at play. In most circumstances, it does not matter who files first. There may be some psychological victory by doing so, but a judge does not care. However, if you need protection or the court to help you out to get child support, spousal support, or a parenting plan the sooner you file, the better.

Can I talk to the opposing party after I've filed?

Yes, as long as you are not in any danger doing so. We find that often many misunderstandings and fighting happen because the parties will not talk to each other. Barring an order of the Court for you to NOT talk, you can keep talking. And when there are children involved, you are expected to talk to one another, as long as it is with respect.

How long does a divorce take?

The minimum amount of time is 90 days. But the real work of a divorce ends when one of three things happens: 1) the parties reconcile, 2) the parties reach an agreement, or 3) a judge makes a ruling after a trial. Most trials will be scheduled for 9 months upon filing but there are some that must wait for two years or more for a trial.
