5 stars for the most amazing and trustworthy lawyer I know. I was hit by a car while walking through a crosswalk in a parking lot. Great question. It depends on what the Traffic Collision Report says (if any), property damage location to all involved cars, and what all the witnesses involved in the collision say. "The witnesses" include not only the three cars who were driving behind you, but anyone else who "saw or heard" the collision. That is the process an experienced lawyer would begin in order to prove who, or which car(s), actually are at-fault for rear ending you. Also, in this scenario, it could be more than one car that would be at fault. For example two cards could be at fault for your rear-end collision, and in California, "comparative fault" laws would help you. For example, sometimes this would be split 50/50 between the two at-fault cars, depending on the facts. Beyond the above, "aggravating factors" should be investigated as well such as: Was anyone texting? Was anyone under the influence of drugs or alcohol at the time of the crash? An experienced Ca injury lawyer can help you for sure.
