This is a Great Question. Based off my experience many reasons why they would not replaced. Maybe at the time of your move in date the carpet could have been considered in "good condition" they were professionally cleaned and sanitized. On your move in condition report you should have noted any issues or damages of carpet condition. There is also another form used to describes the Wear and Tear of carpet, paint,etc. It could very well be time to replace the carpet however it is not illegal to not replace. There would have to be some damage other than "normal wear and tear" such as flood, fire, or structural damage to give warrent for immediate replacement with no charge back to you. Good thing about this is that when you move due to age of carpet they should not charge you back for replacement. UNLESS; the carpets have cigarette, pet urine, non normal wear and tear.
