In Florida, if you own a vehicle that is impounded, you have 36 OR 51 days (based upon year of vehicle) to satisfy the towing, storage & all other charges related to the vehicle that was towed & impounded. If these fees related to the vehicle are not satisfied within that time frame, the vehicle goes to public auction. If a vehicle isn't sold at public auction, we apply for a Certificate of Destruction (to legally dispose of the vehicle & recoup related fees) & affix a Wrecker Operator's Lien (total amount of towing, mileage, 7 days of storage, labor, & admin fees) to the previous owner of the vehicle. If a vehicle DOES sell at public auction, the additional proceeds over the amount of towing & storage fees ARE NOT required to be forfeited to the previous vehicle owner but to the clerk of courts (unlike other liens in Florida). Unfortunately, this is the risk that's assumed when you choose bare minimum insurance coverage. Refer to FL Statute 713.78 to verify info.

Storage/Mechanics Lein. They have the right to collect what is owed. If the car sells at auction for more than you owe in storage fees, they are required by law to give you the extra. However you have one year to collect the extra money or it is forfeited to the State. Good luck.

After 30 days they can file for title to settle the bill, if they don't get what they want they can place a lean until the full amount is settled
