If a retailer has out of date merchandise (nonperishable food), are they allowed by law to give it to food banks or sell it discounted to employees or quick sale for community? This would be better than throwing it away.

Nope.anything out of date would be thrown away..dont want to take a chance on somebody getting sick or possibly die from eating out of date or expired foods..

No they can't nor would you want to. All it would take is for one person to get sick or worse to have a real problem. I know it sounds terrible but to keep everything safe that is the way it is.
