Greg, there is not a penalty for not showing up to your trial. However if you dont show the judge has the right to awarf custody to the othet parent. Also if the other parent is awardwd custody theu cpuld also be awardwd child support as well. I would not recommend you not showing up. FYI. Im a GAL for the courts for 9 years so i know about most matters like this. Just not in your best interest to not show up. With that being said check with your attorney. Good luck. No penalties are enforced they may just continue it which is what my paper work said they would do if we both parties didn't show up. They also could dismiss it or find judgement for the person that does show up, so if you want your voice heard I would advise you to show up.
