I will not assume or jump to conclusion, every situation is different. Hypothetically speaking, it all depends on what type of agreement or arrangement you and the other party agreed to. It varies whether the courts are involved. Who has custody, whether it be Sole, Joint..etc. You would claim your child unless you made an agreement. If you had your child for more than 6 months, then by all means claiming him/her shouldn’t be a problem. The IRS will contact you if (2) people claim a child under the same year it's prohibited. Not only will both parties will be contacted but an investigation and proof of evidence will be requested in support of claiming your child. Mind you this goes to say without having a legal court order that delegates who the child spends his time with. Many people exercise wisdom in keeping the Court from handling there personal business affairs. My suggestion to you is if you have any doubts and need clarification.
