A Living Will addresses a person’s wishes for when he or she is still alive. A Last Will and Testament gives directives after a person’s death to help with the administration of his or her estate. A will has no legal impact until after a person has died, at which time it must be filed with a probate court. Both are important documents and should be included as part of your estate plan.
