It's easy to inspect if the oil has been changed or not. Just check it if you're in doubt. So far with both of our cars, they really change it so no complaints. Take note that if your car runs synthetic oil, they will only change your oil every 10k miles. Don't expect an oil change every 5k.
Is it possible? I suppose errors could be made. But considering the cost/benefit of properly completed task (slight profit margin and pleased customer) vs intentionally not exchanging the oil and filter (wholesale cost of ~$20?), I cannot imagine this very well managed enterprise risking their reputation by falsifying such a simple and easily recognized task. In summary, I doubt but accept the possibility of a mistake, but cannot fathom this as an intentional act.
Unfortunately sometimes they do not change oil but say they did.

Yes. If your car is using synthetic oil, the Toyota recommends every 10k miles with top off every 5k. That is just normal. When they top off for you, there should be no charge as there is no oil change. I have been doing that a long time, and it is not a news or something to complain about. Toyota is #1 not only in the USA, but globally as well.
