I was in a car accident a year ago, and wasn't really going to do anything about it. My brother suggested we just speak with a lawyer and see what happens. Hi Ceecee, frequently when a vehicle has been damaged in a collision, you cannot get full value for it on resale or trade in. This is called diminished value. Washington State allows for diminished value claims. So yes, you can claim diminished value. Be prepared for a fight from the insurance company, however. For the reckless driving, that is a criminal charge the police would decide on at the time the traffic report is filed. Without some aggravating circumstance, ( i.e. racing or DUI) they would likely just charge him with the traffic violation he committed.
