No that's not correct. If you work more than 40 hours a week that counts as O/T. You may submit a "complaint", indicating that your ER is not paying you O/T while working more than 40 hours per week. Please include your ER name and address. With your full contact information and mail it to U. S. Department of Labor-WHD, Dallas Regional office, 525 S. Griffin Street, Room 800, Dallas, TX 75202.
By federal law you have a right to those tips. You may file a complaint on your employer. Come down to 525 S. Griffin St., Room 800, and tell them you are here to file a complaint. Tips are income.
If it's your last paycheck with the company you will have to go to your local workforce commission..... they handle last payday laws

If you work more than 40 hours in a week employers in texas are required to pay 1.5 times your normal pay for each hour that is past the 40 hour mark. Bi-weekly just means your pay arrives every 2 weeks. In other words, every other Monday, or every other Friday. It should have nothing to do with the amount of hours worked.

In these type of cases in Texas, state laws typically take precedence over Federal laws. You should go to a Texas Workforce Commission local Workforce Solutions office to see if your employer is violating any Texas laws and to get assistance if seeing if you qualify for Unemployment Insurance and/or other federal and/or state assistive services.
