Although a will is a great starting point when it comes to estate planning in Illinois, setting up a trust is a good idea for people who have substantial assets or complicated circumstances. One advantage is that while wills must be probated, the property in a trust does not need to go through probate. This means your beneficiaries receive the assets sooner and they will not be depleted by court fees or attorney’s fees. Additionally, a trust will give you more control over the distribution of your assets after your death.

When you sell a home in Illinois, you will be provided with a Residential Real Property Disclosure Report. This form includes a variety of questions about environmental issues, property line disputes, unsafe property conditions, material defects, and flood or damage history in a yes or no format. The exact level of disclosure and determining what needs to be disclosed can be complicated. As a general rule, we recommend that our clients disclose any issues you have doubt about. Doing so can help avoid lawsuits in the future.
