To start the process of filing for divorce you must file with the appropriate Circuit Court a complaint for absolute divorce, and/or a complaint for limited divorce. Once you pay the filing fee and file your complaint, along with a civil domestic information form, you wait until you receive in the mail a summons. You must serve the summons with the complaint and the civil domestic information form on the defendant spouse. You must follow the Maryland rules for proper service in order for your case to start in the courts.
Even if you are getting an uncontested divorce based on 12-month separation or mutual consent where both parties are in agreement that they want to divorce, the Plaintiff (the party who files the case) must go to court and give oral testimony under oath. In a mutual consent divorce, both parties must go to court to give live testimony.
