Not to sure i have always gone in to the office.

So if the law, and contract clearly state "owner is not responsible for damages items out of their control such as earthquake fire or flood" but IS responsible for damages done within his control, such as a rat infestation, should they refund??

Hard to say, but considering that the owner has no access to your unit, probably not. I have mice in my unit and put both traps and poison in there every now and then.
