What kind of debt cant I put into personal bankruptcy? How long does it stay on my credit?

All of your debt must be listed in a Chapter 7 bankruptcy petition. However, there are certain debts that will not be discharged. Those include, but are not limited to student loans, recent tax debt, child support, spousal support, criminal restitution, municipal fines and debts incurred by fraud. The Chapter 7 bankruptcy filing will appear on a credit report for up to ten years. In certain situations, it may be removed earlier if there is an error in proper reporting.

You are eligible to file for Chapter 13. The ability to propose and fund a feasible repayment plan will depend upon your income, expenses and the nature and amount of your debt. Since you have relocated, it is best to consult with an experienced, Chapter 13 bankruptcy attorney in your local area.

What debts are eliminated in a Chapter 7 bankruptcy?

Generally speaking, most debts are discharged in Chapter 7. Medical bills, personal loans, payday loans, credit card debt, debt owed for repossessions, unpaid rent, and utilities are the most common examples for debts eliminated by bankruptcy. In certain situations debt originating from unpaid income taxes can be discharged too.
