When I called to get a refund; he’s been giving me a run around. JEFFREY LICHTMAN OFFICE IS STILL HOLDING ON TO SENSITIVE DOCUMENTS OF MINE. I’m really lost, I don’t know what to do! A criminal case can take as little as weeks to years to resolve, depending on the complexity of the charges and evidence, and whether the case is in the state or federal courts.
Once charges are filed in court in the form of a criminal complaint signed by a law enforcement officer, a defendant is usually arrested and bail is hopefully arranged. At that point the prosecutors have a certain amount of time to present their evidence to the grand jury and seek an indictment.
Rarely is it a good idea to talk to the police before or after an arrest in an attempt to “make things better.” Anything you say can and will be used against you and no credit will be given to you – unless a deal is in place beforehand which is arranged by an attorney.
At an arraignment a defendant is formally notified of his charges, presented his indictment, and the defendant enters a plea of not guilty. Bail is also discussed again.
In criminal cases a defendant faces potential penalties which could include jail time. No one goes to prison in connection with a civil case.
