I have a family member who, as a single mom, adopted four special needs children. She also has two biological children. How can she make sure the needs of all six of her children are taken care of should she pass?

I'm so glad she recognizes that she needs to go beyond hiring a lawyer to write a will. As a Minnesota estate planning attorney, we would draft a special needs trust which is an irrevocable trust to protect her special needs children's inheritance while ensuring they receive necessary medical care and maintain a high standard of living. We would then draft a revocable trust which is a living trust to determine the ages/stages that the children would receive their distributions. Hi Stephanie! You can absolutely protect your biz when you pass. A business succession plan is crucial if you want the business to continue after you pass. As an estate planning lawyer in Minnesota, I work with small businesses and family-owned businesses by creating legal entities (corporations, LLC and partnerships) and draft member control agreements & Buy Sell Agreements. Also, we utilize revocable living trust and assign individual ownership interests of the business to the living trust so the business doesn't die when the owner passes away. Minnesota clients with special needs need to ensure that 1) the special needs family member continues to receive any medical benefits he/she is entitled to and 2) an inheritance is protected from creditors (medical bills, lawsuits, care, etc.). A Minnesota estate planning lawyer can do this by drafting a special needs trust which is an irrevocable trust and appointing a trustee to make sure that when the parent passes, the special needs family member is provided for.
