This store is trying to extort money from me for a product I rented from them that has had multiple failures resulting in the product no longer being viable. They refuse to take the product back. I've tried twice to return it since I notified them that it no longer works months ago. Now they are threatening me w legal charges alledging I have refused to return the product unless I continue to make payments. Even if I could do that financially I still would not pay for something that I cannot use after being harassed in person and via text/ phone calls for months now. I paid for a service plan. It's their property and their responsibility to repair it. This they also refuse. The item is an electric bike. I used it as my only means of transportation to work. $50 a week. Once I was unable to use it for work I had no choice but to put my $50 a week towards another means of transportation. My lawyer says they bear the burden of proof and their store policies do not define the requirements of the law regarding this issue. Another situation of a small corporation trying to line their pockets with my meager income of $500 a week. This amounts to debtors prison. It's a third degree felony they have threatened to charge me with. They can file a report and the DA can press charges with little or no evidence to support the charge. The law does say that they must prove that I have willingly and knowingly refused to return the property to the owner. Yet here it sits at my home. They know it's here. They know their welcome to come get it but would rather use intimidation threats and a 3rd degree felony against me unless I give them money. It comes down to me being able to feed cloth and provide for my children as well as my desperately needed transportstion for work OR pay them for rental property I can no longer afford or even use. If they were to replace two failed/ not destroyed components that my service plan I paid for covers I would be able to continue using and paying for the bike. Now I'd prefer to settle this in court. Then follow up w a lawsuit against the store and it's manager for defamation and false charges. I bet money that his boss at Corporate headcorters will be looking for a new manager when my case gets dismissed. ALWAYS IS A GOOD TIME TO BE WORKING ON YOUR RESUME.
