In Texas, the limitation to file a claim in a personal injury case is known as the "statute of limitations. Generally, an injured party has 2 years from the date of the accident to file a lawsuit and preserve their claim. If an injured party was a minor, that child's claim limitation would be two years from the child's 18th birthday. If it is a claim for uninsured/underinsured motorist insurance, generally the statute of limitations is 4 years. Under Texas law vehicles are required to yield to pedestrians in a cross walk whether marked or unmarked. If a pedestrian is approaching traffic from a sidewalk that crosses an alley, private road, drive way or building, approaching vehicles must yield. If a crosswalk is equipped with traffic lights, pedestrians must only cross when they are facing a green light (unless that signal is a sole green arrow). You have 2 years from the date of the car accident to bring a personal injury claim.
