Who can ask for a divorce under Minnesota law?

A divorce petitioner must be a resident of Minnesota for 180 days (6 months) before they can begin a divorce proceeding. Members of the United States Armed Forces qualify if they have kept their Minnesota residence. Either party can initiate a divorce proceeding, even if one party does not want a divorce. Minnesota Courts have power over people and things in Minnesota, or that were recently in Minnesota (i.e. children who used to live in Minnesota). Nonetheless a spouse can  be served outside of the State of Minnesota, and if the spouse can not be found we can seek to serve by publication or other special service. The power of a Minnesota court in dissolving the marriage, addressing custody, and dividing assets in case such as these are very fact dependent.
