Attorney Mike Rake and Amanda DeDominici from HNB were amazing. Years after I'd given up they kept fighting for what was right. Honestly if it wasn't for Amanda's passion to keep me motivated and the efforts of Mike Rake I would have given up and quit. I'd recommend them to anyone!

wrongful termination if you are out on a disability?

Tim Hoffer | Oct 8, 2018
Horenstein, Nicholson & Blumenthal, LPA | Oct 8, 2018

The fact that a person is off work due to a disability (even if work-related) does not necessarily prevent termination. Many companies have blind absenteeism policies that permit discharge without regard to disability if the employee misses a specified amount of time, typically in the three to six month range. These policies are legal in Ohio. There may be remedies for the employee other than taking legal action against the employer. If the employee is a member of a union with a collective bargaining agreement, then the agreement usually addresses this issue. A consultation with an employment law attorney is recommended.

Harassment in the workplace becomes unlawful where 1) enduring the offensive conduct becomes a condition of continued employment, or 2) the conduct is severe or pervasive enough to create a work environment that a reasonable person would consider intimidating, hostile, or abusive. If you believe the harassment that you are experiencing rises to this level and can produce specific evidence of harassment, you should seek the advice of an attorney for further guidance.
