Thank you very much for your representation of my wife and I against an incredibly nasty wind insurance homeowners company. Our home was destroyed in Hurricane Sally and the insurer denied coverage. The adjuster walked into our house after the storm and said,"yep, this is a total tear down." I agree with the county. Several weeks later they offered me $1,500.with a $5,000 deductible. I could not believe my ears. I asked the reason for the denial and was told "there was NO WIND involved in this hurricane. It was a category 2-3 when it hit NW Florida. My next door neighbor had the same insurance company, did not hire a lawyer, and got nothing. Thank you Vanessa and staff for a job well done!

However, we know that insurance companies don’t always get the facts right, and ignore obvious triggers to coverage. They read their policy incorrectly, to benefit them, even when they are interpreting their own policy language.

If you think you are being mishandled by an insurance company, here are some tips you can use to advocate on your behalf: Mention the term “bad faith” to your adjuster to show them that you know the laws and the duties they owe to you. Hopefully, this makes them act correctly. If this doesn’t work, you can file a Civil Remedy Notice of Insurer Violation with the Department of Financial Services, Insurance Division. This will give the insurance carrier 60 days to pay the claim and correct all the violations. You are giving them a chance to do the right thing. Another option for dealing with bad faith insurance claims is contacting the Department of Financial Services and making a “DFS Complaint”. This will prompt a review of your claim by the management of the insurance carrier. This will not give you any substantive legal rights, but can get the claim moving. Document your claim by hiring experts, getting estimates, taking photos and making lists.

Insurance bad faith practices can include, but is not limited to: Denying coverage without completing a full and accurate investigation; Taking too long to determined that there is coverage for the claim; Ignoring your telephone calls, emails, or letters; Using inaccurate legal or policy terms to diminish your claim; Intentionally dragging out settlement negotiations so statute of limitation laws apply; Refusing to negotiate after you file a valid claim; Failing to deny or pay your claim in a reasonable timeframe; Failing to give you a clear written explanation for why your claim was denied; Misstating the coverages that apply to your claim; Falsely citing local laws or building codes to defend your claim denial or underpayment; The “adjuster shuffle” where your adjuster that knew everything on your file is suddenly replaced by someone that has no idea about your claim.
