These are conducted in Juvenile Court in order to determine whether a Juvenile must be held in custody pending resolution of their case, or if not, to determine the release conditions if not being held in a Juvenile Detention Center. Juvenile Court Judges will most of the time allow the juvenile defendant to remain at home if they are not a flight risk or danger to the community and they will listen to their parent or guardian that is in the home with them.
Yes. The “first appearance” hearing is a critical stage in a criminal case whereby conditions of release are pronounced after a determination of probable cause for the arrest. These hearings should take place within twenty-four hours after an arrest. In some cases, a person can bond out of jail in advance of this hearing. More and more charges are becoming ineligible for bond until after the “first appearance” hearing. Securing representation in advance of the hearings will enable your attorney the educate the Court about your good standing in the community, lack of criminal history (if applicable), and significant ties to the community that will make you less of a flight risk and may result in a significantly lower bond amount.
