Questions & Answers

What is a bail hearing?

This will be an official Court Hearing held in order to establish a bond if one is not already set or in most cases, to reduce a bond to a more attainable and reasonable amount with conditions so that an accused can be released from Jail pending Trial or resolution of their case instead of sitting in Jail. Often times there is a testimony and other evidence presented to the Judge in order to support the accused arguments for pre-trial release.

Will I have to testify in court?

You cannot be compelled to testify in a criminal case; in court or otherwise. This privilege is guaranteed by the Fifth Amendment of the United States Constitution which gives you the right not to be compelled to make a self-incriminating statement that will then be used by the Government as evidence against you. The decision not to testify (or invoke this right) may not be considered by a jury as an indication of guilt.
