I would highly recommend this firm to anyone in need of criminal defense. I engaged them to handle a criminal matter for a family member. The charges were quite serious with the potential of significant jail time. This was my first encounter with this type of legal issue and I was quite concerned and nervous about the whole ordeal. Brett Rosen was the attorney assigned to our case, and I am grateful that he was. He has a strong command of the law, the court system and the whole process. He is respectful and considerate when discussing the case. I never felt uncomfortable sharing the details of the events leading up to the criminal act. He always returned my email messages very quickly and took as much time as necessary to explain things to me. The case was resolved last week with without any jail time and minimal probation time. When we met Brett (for the first time) at court, he was upbeat and very reassuring, which was appreciated by myself and the family member, on a very trying day. The penalties for a first offense DWI in New Jersey hinge on whether the violation was for alcohol intoxication or for driving under the influence of drugs. For an alcohol based charge, the suspension period is 3 months if the blood alcohol concentration (BAC) is at least .08% but less than .10%. The suspension period is 7-12 months for a BAC of .10% or more. When the arrest is based on marijuana, heroin, cocaine, prescription drugs (e.g. opiates) or another form of CDS, the suspension is at least 7 months and can also reach up to 12 months. The other penalties are substantially the same (e.g. fines, jail, etc.) irrespective of the BAC or the type of intoxicant. The consequences substantially increase for a second offense and third offense.
