Typically, yes, you will have to see your employers doctor. However, Louisiana gives you the right to also see your own doctor. If you see your own doctor for the injury before the employers doctor, you may still be required to be attended to by their doctor as well.
Workers Compensation insurance covers injuries that occur at work or in the course and scope of employment. For example, if you are injured while traveling for your business, this is covered.
Employers typically do not pay indemnity benefits but will have an insurance company that does this for them. Louisiana law requires employers to have some form of insurance, whether it is self-insured or through an insurance company.
Not every work-related injury will be covered by Workers Compensation. Some of these injuries include injuries arising out of intoxication in the workplace; injuries caused by a fight started by the employee against another; or intentional injuries for the purpose of receiving benefits.
Workers Compensation covers medical bills and expenses, lost wages, ongoing care costs, funeral expenses, or any other costs that arise because of a work-related injury.
The three most common reasons why workers' compensation claims might get denied is are the application missed the deadline, the employer claims you were responsible for your injuries, and you failed to seek medical attention. If you've been injured or sicked on the job in Louisiana, make sure you report the incident to a supervisor or someone in human resources immediately. Then you must seek medical care so the injuries or illness can be properly documented.
If you are being threatened by your company or find yourself in a potentially damaging legal situation due to a work or personal injury, you shouldn't have to go it alone. Hiring an experienced workers' compensation attorney to take care of everything or you, from the first phone call until the case is over.
For the most part, the statute of limitations in Louisiana is one year. Civil lawsuits seeking damages following an injury must be filed within one year from the date the plaintiff suffered injury or property damage. This deadline of one year applies to any and all cases that would involve car accidents, slip and fall accidents, premises liability accidents and any other accident involving negligence. It also applies to cases involving intentional tort, such as assault.
Injuries from truck accidents, motorcycle accidents, car accidents, and slip and fall injuries all qualify as personal injuries. Many people are worried they wont be able to file a lawsuit against the at-fault party, but we want you to understand your options so you know when you are able to hold someone else responsible for their actions or inaction.
An accident caused by someone elses negligence that has left you injured should not leave you in a financial rut. Its important that you always hire an experienced personal injury attorney after being injured in any type of accident (car, construction, workplace, slip and fall, etc). By doing so, you are putting yourself in the right position to recover compensation for your injuries.
