The Phoenix City Court is located at 300 Washington St, Phoenix, AZ 85003. My office is about 2.5 miles away. It should be around an 8 minute drive. 1. When you leave the court head north on N. 3rd Ave toward W. Adams Street (1.2 mi) 2. Turn right onto W. McDowell Road (for 0.8 mi) 3. Turn left onto N. 7th Street (0.6 mi) 4. Arizona has many different types of misdemeanor DUI offenses. Misdemeanor crimes have less severe penalties than felonies. Misdemeanor DUI cases are usually filed in either the City Courts or Justice Courts. The several different categories of misdemeanor DUI crimes in Arizona are: 1. Impaired to the Slightest Degree by Alcohol - Arizona law does not actually define the word "impaired" or what to the "slightest degree" means. As you can imagine this has created a lot of confusion. 2. Alcohol Concentration of .08 or Greater. 3. Extreme DUI - Alcohol Concentration of .150 or Greater. 4. Super-Extreme DUI - Alcohol Concentration of .200 or Greater. 5. DUI Impaired by Drugs. Lawrence Koplow
In the vast majority of cases - no. Under Arizona law (Arizona Revised Statutes §13-3883) a peace officer (i.e. a police officer) may arrest a person without a warrant if the officer has probable cause to believe: 1. A felony has been committed and probable cause to believe the person to be arrested has committed the felony. 2. A misdemeanor has been committed in his presence and probable cause to believe the person to be arrested has committed the offense. 3. The person to be arrested has been involved in a traffic accident and violated any criminal section of title 28, and that such violation occurred prior to or immediately following such traffic accident. 4. A misdemeanor or a petty offense has been committed and probable cause to believe the person to be arrested has committed the offense. Lawrence Koplow
Yes...to the extent Arizona does (what many people commonly understand is) an “expungement.” Arizona does not have a procedure that is officially titled “expungement” that completely removes a conviction in most cases. However, Arizona does have a procedure to mitigate the impact of a criminal conviction on your personal and professional life. This procedure is called a “set aside.” A set aside vacates a conviction and discharges all your obligations. That is, it sets aside the judgment of guilt, dismisses the accusations against you and orders that the you are - released from all penalties. A “set aside” is the closest legal mechanism Arizona has to what other states call an “expungement. “ In addition, there is one circumstance where Arizona law does permit a person to expunge an adult arrest record. If your attorney can prove that you were “wrongfully arrested” Arizona law gives a judge discretion expunge and seal the arrest record. Lawrence Koplow

Yes. Being surprised that you have a warrant (even for a misdemeanor) is more common than you may think. There are many instances where courts have issued a warrant because people were not given proper notice. There are also cases where a person was just in a bad place and missed their court date. I resolve warrants for clients frequently. In short, warrants in court like Phoenix and Scottsdale are usually easier to fix than people think. Lawrence Koplow
