Under North Carolina law, a wrongful death lawsuit may only be filed by the personal representative of the decedent. Normally, the personal representative means the executor or administrator of the decedent’s estate. If no estate is opened for the decedent, the court can appoint a personal representative to pursue the wrongful death claim. In most cases, the personal representative role is filled by a close family member, such as a spouse, parent, adult child or grandchild, or sibling.
- Report the accident to law enforcement and save a copy of the police crash report. - Get the names and contact information for everyone involved, including witnesses. - Take photos or videos of the accident scene, including vehicle damage, skid marks or debris on the road, traffic signals and crosswalk lines at the scene, and weather and lighting conditions at the time of the accident. - Seek medical attention as soon as possible to have any injuries diagnosed by a medical professional. Take photos of visible injuries. Follow any treatment instructions you are given and do not delay attending any recommended medical appointments. - Keep copies of medical bills and other invoices for expenses that you incur, as well as copies of your pay stubs or income statements. - Avoid posting about the accident, your injuries, or your legal claim on social media. - Do not give a statement to the driver’s insurance company without speaking to an attorney.
